Terms of Use

Agreement

Bloomit is provided by Thought Garden Labs LLC, based in New York (“Thought Garden Labs,” “we,” “us”). By creating an account or using Bloomit, including its Share extension and Siri Shortcuts, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use Bloomit.

The service

Bloomit helps you sort and keep your photos, screenshots, links, notes, voice memos, and videos in private collections called gardens, and helps you find them again. Bloomit is a personal organizing tool. It is not therapy, medical care, or a crisis service; if you need urgent help, contact local emergency services.

We work to keep Bloomit available and accurate, but sorting is automatic and may sometimes put an item in the wrong garden or none at all. We may add, change, or remove features over time.

Eligibility and accounts

You must be at least 13 years old to use Bloomit. If you are under 18, or under the age of majority where you live, you may use Bloomit only with the involvement of a parent or guardian who agrees to these terms.

You are responsible for keeping your sign-in details secure and for activity under your account. Tell us promptly at support@bloomit.net if you think your account has been used without permission.

Your content

You own what you save in Bloomit. We do not claim ownership of it. You give us a limited, non-exclusive, worldwide, royalty-free permission to host, store, copy, and process your content only as needed to operate, secure, and improve Bloomit for you, as described in the Privacy Policy, including the optional suggestions described below. This permission ends when you delete the content or your account, except for copies in routine backups until they expire.

Bloomit is private. It has no public feed, and your gardens are not shared with other users. You are responsible for having the rights to what you save, including images and links you share into Bloomit.

Photos and permissions

When you give Bloomit access to Photos, it reads your library to sort it on your iPhone. Bloomit does not add, edit, move, or delete photos in your library. A photo sorted from your library is stored in your account as a reference to that photo; if you delete the photo from your library, Bloomit can no longer show it. You can change Bloomit’s access at any time in iOS Settings.

Suggestions

Bloomit may suggest gardens, titles, themes, and, if you opt in for a photo, a short description. Some suggestions are made with the help of a third-party AI provider, as the Privacy Policy explains. Suggestions can be wrong, so review them before you rely on them. A suggested description is never saved unless you choose to use it.

Acceptable use

You agree not to:

• use Bloomit to store or send unlawful content, or content that exploits or harms children;
• infringe anyone’s intellectual property, privacy, or other rights;
• probe, disrupt, overload, or gain unauthorized access to Bloomit, its servers, or other people’s accounts;
• reverse engineer the app except where the law allows; or
• resell or commercially exploit Bloomit without our written permission.

We may suspend or close accounts that break these rules.

Bloomit Plus subscriptions

Bloomit offers a free tier and an optional auto-renewable subscription, Bloomit Plus, sold through Apple’s App Store. Free includes saving from the Share sheet, notes, voice notes, photo and video saves, sorting of recent photos, a limited number of gardens, search, viewing, and export. Bloomit Plus adds features such as full-library sorting, unlimited gardens, custom sorting rules, More like this, natural-language search, and the daily bloom. The current list of Plus features is shown in the app before you subscribe.

Price and length

Bloomit Plus is offered monthly and yearly. The price, in your local currency, and any free trial are shown on the App Store purchase sheet before you confirm; that sheet controls.

Auto-renewal

• Payment is charged to your Apple account when you confirm the purchase.
• The subscription renews automatically for the same length unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple account is charged for renewal within the 24 hours before the current period ends, at the then-current price. If the price changes, Apple will notify you as its rules require.
• If a free trial is offered, the subscription begins and is charged when the trial ends unless you cancel at least 24 hours before it ends. Any unused part of a free trial is forfeited when you purchase a subscription.
• You can manage or cancel at any time in your iPhone’s Settings under your name, then Subscriptions, or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current period.
• Deleting the app or your Bloomit account does not cancel the subscription. Cancel it with Apple.

Refunds and restoring

Apple handles all billing, and refund requests go to Apple at reportaproblem.apple.com under Apple’s policies. Use Restore Purchases in Bloomit’s Settings to restore an active subscription on the same Apple account.

Your saves stay yours

If your subscription ends, everything you already saved stays viewable and exportable. Only Plus features stop.

Beta versions

We may offer test versions of Bloomit through Apple’s TestFlight. Beta versions may include features without charge, may be unstable, and may change or end at any time. Please keep your own copies of anything important.

Apple and the Standard EULA

Bloomit is licensed to you, not sold. Your use of the app is governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”) and by these terms, which add to it. If these terms conflict with the Standard EULA, these terms control to the extent the Standard EULA allows. In addition:

• These terms are between you and Thought Garden Labs only, not Apple. Thought Garden Labs, not Apple, is solely responsible for Bloomit and its content.
• Apple has no obligation to provide maintenance or support for Bloomit.
• If Bloomit fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Bloomit.
• Thought Garden Labs, not Apple, is responsible for addressing any claims relating to Bloomit or your use of it, including product liability claims, claims that it fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
• If a third party claims that Bloomit or your use of it infringes their intellectual property, Thought Garden Labs, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism, and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and Apple may enforce them against you.

Third-party services

Bloomit relies on services from other companies, including Apple, Supabase, RevenueCat, and Anthropic. Links you save open in other apps and websites that we do not control, and their own terms apply there.

Our property

Bloomit, its name, icon, design, and software belong to Thought Garden Labs and its licensors. Apart from the license to use the app under these terms and the Standard EULA, no rights are granted to you. If you send us ideas or feedback, we may use them without obligation to you.

Ending your use

You may stop using Bloomit at any time and delete your account in Settings → Delete account, which removes your saved content as described in the Privacy Policy. We may suspend or end your access if you break these terms, if required by law, or if we discontinue Bloomit; where reasonable, we will give you notice and a chance to export your content first. Sections that by their nature should survive will survive.

Disclaimers

To the fullest extent permitted by law, Bloomit is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that Bloomit will be uninterrupted, error-free, or that sorting or suggestions will be accurate. Keep your original photos and files in your own library and backups.

Limitation of liability

To the fullest extent permitted by law, Thought Garden Labs and its members, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from or related to Bloomit. Our total liability for all claims relating to Bloomit is limited to the greater of the amount you paid for Bloomit Plus in the 12 months before the claim or US $50. Some places do not allow these limits, so they may not apply to you, and nothing in these terms limits rights you have under consumer law that cannot be waived.

Indemnity

To the extent the law allows, you agree to indemnify Thought Garden Labs against claims arising from content you save or share through Bloomit or from your breach of these terms.

Governing law

These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in New York County, New York, and you and we consent to their jurisdiction. If you live outside the United States, you also keep any protection given to you by the mandatory laws of your country.

Changes

We may update these terms as Bloomit changes. We will post the new version here with a new date and, for material changes, tell you in the app or by email before they take effect. If you keep using Bloomit after that, you accept the updated terms. If any part of these terms is unenforceable, the rest remains in effect.
